In our February newsletter we introduced the new “Unitary Patent” (UP) and highlighted the need for business to consider the impact it will make on IP strategy. The key perceived differences with the current European Patent Convention (EPC) system, which will continue to run alongside, are repeated in this link ( click here ) as a reminder.
The legal process required for the Unified Patent Court Agreement (UPCA) to enter into force (EIF) is now unlikely to complete before Spring 2018. However, the Stratagem IPM team are pressing ahead to ensure we prepare patentees for the consequences, some of which occur on day 1 of system operation.
The first step is to decide if there’s any benefit in opting your commercially relevant granted patents out of the new system and/or delaying soon-to-grant applications to take advantage of it.
